The Court:- The Will has been proved in common form by the two attesting witnesses. This is an application for grant of probate of the last Will and Testament dated July 27, 2022 left behind by the above-named deceased. The Will is registered in the Office of the District Sub-Registrar IV - Alipore, South 24 Parganas on July 29, 2022. The mother of the testator has predeceased the testator. Paragraph 5 of the petition indicates that the testator has left behind no legal heirs. A No Caveat Certificate has been issued by the department which shows that no caveat has been lodged despite issuance of general citation as well as publication thereof. Having regard to the aforesaid and since the file has been placed before this Court by the Registrar-in-Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (c) of the petition. Accordingly, PLA/29/2024 stands disposed of.
