In this writ petition the petitioner has sought for an innocuous relief that her prayer vide letters dated 26th November, 2021 and 6th February, 2024 be considered and disposed of by the respondent no. 3/the District Inspector of Schools(S.E.), Dakshin Dinajpur. 2. Learned advocate for the petitioner has submitted that higher scale is claimed by the petitioner pursuant to her enhanced qualification, which she obtained with due permission granted by the respondent D.I. for enhancement of qualification. 3. It is further submitted that the law in this regard is now well settled particularly in view of ratio decided by the Full Court in the judgment of Utpal 2 Kanti Karan-vs-State of West Bengal reported in 2024 SCC Online Cal 1274. 4. Ms. Dutta, learned advocate appears for the State through virtual mode. 5. Let this writ petition be disposed of by directing the respondent no. 3/District Inspector of Schools(S.E.), Dakshin Dinajpur to consider and dispose of the petitioner’s two applications as mentioned above, after affording reasonable opportunity of hearing to her and only in accordance with law. 6. Let the exercise as above be concluded by the said respondent authority, within a period of eight weeks from the date of communication of this order. 7. Needless is to mention that in case, the petitioner’s prayer for grant of higher pay scale is considered favourably by the said respondent, all consequential orders for re-fixation of her pay scale and grant of arrear salary shall be made immediately thereafter. 8. Otherwise, the said respondent shall pass a reasoned order and communicate a copy thereof to the petitioner within one week from the date of order. 3 9. The writ petition, along with application, is disposed of. 10. Parties shall act on a server copy of this order duly downloaded from the official website of this Court. (Rai Chattopadhyay, J.)
