The applicant has filed these applications for delay, setting aside the abatement of sole respondent and bringing on record legal heirs of deceased sole respondent. The applicant has stated that the applicant has filed the application for condonation of delay in filing the appeal. When the notices were issued, from the bailiff report, the applicant came to know that the sole respondent died on 03.03.2023 and thereafter the applicant has taken steps to bring on record the legal heirs of respondent. The delay is of 1160 days. Considering the reasons stated in the applications, delay is condoned, abatement is set aside and the applicant is permitted to bring on record the legal heirs of sole respondent.
