1. The petitioners have filed these petitions seeking transfer of two proceedings between the parties to New Delhi District, Patiala House Courts. 2. The prayers in the petitions are as follows:

“(a) Transfer the DV Case bearing CT Cases no. 129/2023 pending adjudication before Ld. Mahila MM-02, Shahdara District, Karkardooma Courts to New Delhi District, Patiala House Courts; (b) Pass any such other order or order (s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case as well This is a digitally signed order. Mahila MM-02, Shahdara District, Karkardooma Courts to New Delhi District, Patiala House Courts; (b) Pass any such other order or order (s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case as well as in the interest of justice.”

The proceedings arise out of matrimonial disputes between petitioner No.1 in both cases, and respondent No.1 in TR.P.(CRL.) 29/2024 (respondent No.2 in TR.P.(CRL.) 30/2024) [hereinafter, “Ms. S”]. 4. I have heard Mr. Abhinav Sharma, learned counsel for the petitioners, and Ms. S, who is herself an advocate and appears in person. 5. It may be noted that, by order dated 17.11.2023 in TR.P.(C.) 5/2023, proceedings under the Hindu Marriage Act, 1955, between the same parties, were transferred from the Family Courts, Shahdara District, Karkardooma Courts, to the Family Courts, New Delhi District, Patiala House Courts.
By order dated 28.11.2023 in Special Leave to Appeal (C) No(s). 25967/2023, the Supreme Court declined special leave to appeal. 6. Although the parties have argued at length, it is unnecessary to adjudicate their contentions on merits because both parties consent to transfer of the proceedings to the Central District, Tis Hazari Courts. The statement of Ms. S has been recorded separately. The statement will be kept in a sealed cover. The name of Ms. S will be redacted from the statement in the publicly available electronic record. 7. Mr. Sharma also consents to the aforesaid order. 8. The matters be placed before the Court of learned Principal District and Sessions Judge, Central District, Tis Hazari Courts, Delhi, for assignment to a court of competent jurisdiction, on 23.02.2026. 10.
