This is a petition filed under Section 528 Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, for quashing of cross case bearing GD No.024 dated 08.05.2020, registered under Sections 324, 149 IPC (Sections 326, 325, 323, 148 of IPC added lateron) at Police Station Koom Kalan, Dis- trict Ludhiana in case FIR No.83 dated 08.05.2020, registered under Sec- tions 452, 324, 447, 506, 148, 149, 427 IPC (Sections 323, 325, 326 IPC ad- ded lateron), at Police Station Koom Kalan, District Ludhiana and sub- sequent proceedings arising therefrom on the basis of compromise dated 09.01.2023 (Annexure P-2). 2. Vide order dated 06.04.2026, passed by this Court, the parties were directed to appear before the trial Court/concerned Court to get their statements recorded and the learned Magistrate was directed to send its re- port qua the genuineness of the compromise. 3. Pursuant to the aforesaid order, parties have appeared before the Judicial Magistrate Ist Class, Ludhiana and got their statements recorded. On MAMTA MALHOTRA 2026.05.01 16:11 I attest to the accuracy and authenticity of this order/judgment Chandigarh CRM-M-50705-2024 2 the basis of the statements so recorded, Judicial Magistrate Ist Class, Ludhiana has submitted report dated 18.04.2026 to the effect that the com- promise has been effected between the parties voluntarily and without any coercion or undue influence. 4. Learned State counsel as well as counsel for respondents No.2 to 5 have not disputed the factum of compromise between the parties. 5. In view of the above, no useful purpose would be served to con- tinue with the proceedings before the trial Court in the instant FIR. 6. Following the principles laid down by the Full Bench judgment of this Court in Kulwinder Singh and others Versus State of Punjab and another 2007 (3) RCR (Criminal) 1052 and approved by the Hon’ble Su- preme Court in Gian Singh Versus State of Punjab and others (2012) 10 SCC 303, this petition is allowed and cross case bearing GD No.024 dated 08.05.2020, registered under Sections 324, 149 IPC (Sections 326, 325, 323, 148 of IPC added lateron) at Police Station Koom Kalan, District Ludhiana in case FIR No.83 dated 08.05.2020, registered under Sections 452, 324, 447, 506, 148, 149, 427 IPC (Sections 323, 325, 326 IPC added lateron), at Police Station Koom Kalan, District Ludhiana and subsequent proceedings arising therefrom on the basis of compromise dated 09.01.2023 (Annexure P-2) are quashed. 7. Pending miscellaneous application(s), if any, stand(s) disposed of, accordingly.
