2. The present writ petition has been filed for following reliefs :-
“(i) For issuance of a writ for a direction to the respondents authorities to restrain the construction work of boundary wall by respondent no. 7 by which respondent no. 7
Patna High Court CWJC No.6536 of 2024(5) dt.13-08-2026 2/2 obstructing the common way (rasta) of petitioners which restricted the access of petitioners to their respective plots permanently.
2. For issuance of an appropriate writ for direction to respondent authorities to protect the common way (rasta) of petitioners for their access to their own plot. “
3. After arguing at length, the learned counsel for the petitioners seeks permission to withdraw the present writ petition with liberty to avail appropriate remedy before the appropriate forum.
4. Permission, as prayed for, is granted.
5. As such, the present writ petition stands dismissed as withdrawn, with the aforesaid liberty.
6. It is directed that the lower court/ appropriate authority shall look into the issue of limitation afresh, taking into account the fact that the petitioner had approached the Hon’ble High Court by way of instant writ petition.
