Heard the learned Counsel appearing for the applicants.
02. By the present application, the applicants are seeking condonation of delay of 50 days caused in filing the application for restoration of the appeal.
03. The learned Counsel appearing for the non-applicant strongly opposed the application.
04. However, considering the grounds set out in the application, the delay of 50 days caused in filing the application for restoration of the appeal, which came to be dismissed for want of prosecution for non-filing of the paper-book, vide order dated 06/09/2023, is hereby condoned.
05. The application is allowed and disposed of accordingly. Civil Application [MCA] St. No.3844/2024: Heard.
02. For the reasons set out in the application, the application for 2026:BHC-NAG:11579
920.cao.1394.24 2/2 restoration of the appeal is allowed, subject to payment of costs of Rs.1,000/- (Rupees One Thousand Only) in the account of the “Public Welfare Account” maintained by this Court with the Union Bank of India, within a period of one week from today.
03. Upon compliance with the condition of payment of costs, the appeal be registered at its original stage. First Appeal No.1707/2019: The appellants shall file the private paper-book within a period of twelve weeks from today, failing which the order of dismissal of the appeal shall stand restored automatically, without reference to the Court.
