The present writ petition has been filed for the removal of encroachmnt of land situated in Mouza-bhirha Thana No-66 Khata-2861(old),2403(new) Khesra 3461(old) 1663(new) Area-13, Decimal nature-Anabad sarv sadharan. 3. The Learned counsel for the petitioner submits that in spite of repeated requisite requests to the authorities concerned, encroachment has not been removed, and the encroachment still exists. The Learned counsel for the State in his counter affidavit stated that all encroachment has been removed and the specific submission of the learned counsel of the State that the construction is on the rayati land and since it is on the rayati land, it’s not the responsibility of the State to initiate a proceeding under the Bihar Public Land Encroachment Act, 1956. 5. Having heard the parties and in view of the specific submission of the Learned counsel for the State wherein it has been stated that the encroachment has been removed from the land in question, I am not inclined to interfere in the present writ petition. 6. In view of the above, the present writ petition is disposed of with an observation, that the authorities concerned shall look into the issue of fresh encroachment if any and shall proceed in accordance with law.
