2. These applications have been filed for canceling the anticipatory bail granted to the opposite party no.2
Patna High Court CR. MISC. No.65093 of 2024(3) dt.23-07-2026 2/3 in both the cases by a Coordinate Bench of this Court vide order dated 09.01.2023 passed in Cr. Misc. Nos. 46432 of 2021 and 51025 of 2021, in connection with Agamkuan P.S. Case No.327 of 2021 registered for the offence under Sections 420, 406, 504 and 506/34 of the Indian Penal Code.
3. The petitioners have prayed for canceling the bail bonds of the opposite party no.2 on the ground that they have failed to comply the undertaking given before this Court.
Learned Counsel for the petitioners submit that an application for canceling the bail bonds of the opposite party no.2, in both the cases has been filed in the Court of A.C.J.M.-IV, Patna City on 06.07.2023 but the same is still pending.
4. In these circumstances, the A.C.J.M.-IV, Patna City or his successor is directed to dispose of the pending application of the petitioners within fifteen days from the date of receipt/production of a copy of this order. If the Magistrate finds that the opposite party no.2, in both the cases, have not complied the undertaking given before this Court, he shall cancel their bail bonds.
5. Accordingly, these applications stands
disposed of.
6. The A.C.J.M.-IV, Patna City or his successor
Patna High Court CR. MISC. No.65093 of 2024(3) dt.23-07-2026 3/3 is directed to file a show cause as to why the application for canceling the bail which has been filed on 06.07.2023 is still pending since last three years.
7. The show cause must be filed within two weeks from the date of receipt/production of a copy of this
order.
8. List this case after two weeks for
consideration of show cause.
9. Let a copy of this order be communicated to the learned Principal District & Sessions Judge, Patna forthwith through FAX or Email for its compliance.
