Also heard Mr. D Kalita, learned counsel for the respondent. In deference to the earlier order dated 03.06.2026, Smt. Justice Rumi Kumari Phukan, Former Judge, Gauhati High Court, who was appointed as a sole Arbitrator to arbitrate and decided on the dispute arising by and between the parties, has furnished a written declaration under Section 12 (5) of the Arbitration and Conciliation Act, 1996. In the said written declaration, she has expressed no difficulty or hardship to act as a Sole Arbitrator in the matter. In that view of the matter, the appointment of Smt. Justice Rumi Kumari Phukan, Former Judge, Gauhati High Court to act as a sole Arbitrator to arbitrate and decide on the disputes arising by and between the parties in connection with the partnership agreement executed on 22.01.1998 and the supplementary partnership deed executed on 05.09.2023 relating to their Page No.# 3/3 partnership firm run under the name and style “M/s Kamla Tea Processing Udyog” is hereby confirmed. A copy of this order be communicated by the Registry to Smt. Justice Rumi Kumari Phukan, Former Judge, Gauhati High Court. The parties shall appear before the learned Arbitrator on 08.07.2026. Parties are also at liberty to furnish the certified copy of this order before the learned Arbitrator appointed by this Court. The Arbitration Petition stands disposed of. JUDGE Comparing Assistant
