The writ petition alleges arbitrary action on the part of the respondent CESC Authorities in not supplying electricity to the petitioner’s residential premises. 2. The petitioner’s application for Domestic supply has been declined by the respondent CESC Authorities by a letter dated July 07, 2024. The said letter dated July 07, 2024 reveals that supply to the petitioner’s residential premises has been declined on the ground that the petitioner is already deriving supply from an existing connection and that the application for fresh electricity connection has been made with the intent of splitting of the existing load in order to obtain the benefit of lower charges which is not permitted by regulation 14 of the West Bengal Electricity Regulatory Commission (Recovery of Expenditure for Providing New Connection) Regulations, 2013. 2 3. In terms of the said regulations, if a request for grant of electricity is declined on the ground of splitting of load, the applicant has a statutory remedy before the Grievance Redressal Officer. 4. Accordingly, this writ application is not entertained. The petitioner is granted liberty to approach the relevant Grievance Redressal Officer seeking redressal of her grievance as regards non grant of electricity supply on the ground of splitting of load, in accordance with law. 5. It is made clear that this Court has not gone into the merits of either the petitioner’s case or the respondent licensee’s objection to the grant of electricity supply and all points are left to open the decided by the Grievance Redressal Officer in accordance with law. 6. It is expected that if such an application is made by the petitioner, the Grievance Redressal Officer would dispose of the same in accordance with law as expeditiously as possible. 7. With the above observations, WPA 28575 of 2024 stands disposed of. There shall be no order as to costs. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.) 3
