2. The present application has been filed by Respondent No.2- Gulshan- E-Iqbal Cooperative Group Housing Society Ltd. (hereinafter, ‘Society’) seeking clarification of paragraph 23 of the final order dated 19th March,
2026.
3. The relevant paragraph 23 of final order dated 19th March, 2026 is set out below:
“23. Accordingly, the Rule 90 Committee’s decision dated 27th October, 2023 is set aside. The possession of the vacant flat in the society shall be handed over to the Petitioner within a period of two weeks from today.”
4. The Society is seeking directions to the Delhi Development Authority to conduct the draw of lots, for giving possession, as there are two flats which This is a digitally signed order. are stated to be vacant. Additionally, it is also stated that there is one flat which is in respect of another member i.e., Mr. Praveen Kumar, who has a pending CBI case against him.
5. Considering that there are only two flats which are vacant, and are identical in nature, in view of the short issue involved, the Court does not wish to delay the matter further. Accordingly, let Flat B1001 be allotted to the Petitioner.
6. The application is disposed of in the above terms.
