DATE : 25.08.2026 By this application, the applicants seek leave to withdraw Criminal Application (APPA) No.577 of 2024, preferred in Criminal Appeal No.324 of 2024, with liberty to the applicants to assail the order dated 28.11.2023 passed in Sessions Trial No.121 of 2003 by way of an appropriate proceeding in revision before the competent Court. 2. In view of the various reasons mentioned in the application, leave is granted to the applicants to withdraw Criminal Application (APPA) No.577 of 2024 with liberty to raise the issue in an appropriate proceeding. The Revisional Court shall consider the application, if filed by the applicants for addition of the accused, keeping in view the fact that the 2026:BHC-NAG:11186-DB 19.APPEAL.324.2024 & Anr. 2/2 said application was pending before this Court while considering the application for condonation of delay. 3. The pendency of the present appeal shall not come in the way of the Revisional Court in deciding the revision. 4.
