Bhattacharyya, learned counsel for the applicants and Mr. A. Acharya, learned counsel for the opposite party No. 1. 2. Referring to the Office Note, dated 01.06.2026, Mr. Bhattacharyya submits that notice upon the respondent Nos. 2(i), 2(ii), 2(iii), 2(iv) & 2(v) stands served. Page No.# 10/11 3. Said Office Note also indicates that the notice issued to the respondent No. 3 could not be served as the said respondent was not found at the address and local residents also had no knowledge about him. 4. Mr. Bhattacharyya, learned counsel for the applicants submits that for the purpose of this application, the presence and hearing of the respondent No. 3 may not be required and as such, he has contended to allow this application, which is filed under Section 5 of the Limitation Act, 1963, for condonation of delay of 4874 days in filing the application for setting aside the abatement in respect of the respondent No. 2; and the delay of 4934 days in substituting the legal heirs of the deceased respondent No. 2. 4.1 Mr. Bhattacharyya further submits that the respondent No. 2 had suffered demise on 31.07.2010. But, the legal heirs of the said respondent could not be impleaded and the reason for the same has been explained in paragraph No. 3 of the application and under such circumstances, Mr. Bhattacharyya submits that the delay in filing the application for setting aside the abatement and for substituting the legal heirs of the deceased respondent No. 2 may be allowed. 5. Mr. Acharya, learned counsel for the opposite party No. 1 submits that he has no objection in the event of allowing the same. 6. Accordingly, taking note of the submission of the learned counsel for both the parties, this interlocutory application stands allowed. 7. The delay of 4874 days in filing the application for setting aside the abatement in respect of the respondent No. 2 stand allowed, and the delay of 4934 days in substituting the legal heirs of the deceased respondent No. 2 stands condoned. 8. In view of the order passed in this I.A.(Civil) No. 1423/2024, the I.A.(Civil) Nos. 1424/2024 and 1422/2024 stands closed. Page No.# 11/11 9.
