JUSTICE ANUP JAIRAM BHAMBHANI O R D E R % 05.02.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner and complainant/respondent No. 2, seek quashing of case FIR No. 383/2024 dated 10.09.2024 registered under sections 281/125 of the Bharatiya Nyaya Sanhita, 2023 (‘BNS’) at P.S.: Neb Sarai, South District, Delhi.
2. The petition is premised on Memorandum of Understanding dated 24.09.2024, whereby the petitioner and respondent No. 2 have resolved the matter amicably.
3. The petition is also supported by affidavits of the petitioner and of respondent No. 2, alongwith proof of their IDs.
4. The petitioner is present in court and respondent No.2 has joined via video-conferencing. This is a digitally signed order. 5. Respondent No.2 is a teacher by profession and is articulate; and clear in her views.
6. Respondent No.2 submits, that injuries sustained to her left lower limb where she now wears a prosthetic leg, was not by reason of any fault on part of the petitioner who was driving a Delhi Jal Board tanker.
7. Respondent No.2 further submits, that she did not even prefer an MACT claim; and that she does not wish to receive any kind of medical reimbursement or any other compensation from the petitioner.

Learned counsel for the petitioner has also shown to the court certain CCTV footage which quite clearly captures the manner in which the incident occured.
9. The credentials of the parties have been verified by the I.O..
10. The court has interacted with respondent No.2, as also with petitioner, who have confirmed that they have now resolved the matter and a Memorandum of Understanding dated 24.09.2024 has been signed by them closing all issues amicably. Parties now wish to live in peace and harmony going forward.
11. Mr. Sanjay Lao, learned Standing Counsel confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be This is a digitally signed order. W.P.(CRL) 3037/2024 quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties.
13. Accordingly, case FIR No. 383/2024 dated 10.09.2024 registered under sections 281/125 of the BNS at P.S.: Neb Sarai, South District, Delhi is quashed. All proceedings arising therefrom also stand closed.
14. Petition stands disposed-of.
15. Pending applications, if any, also stand disposed-of.
