Ms. Debangana Dey, Adv. …for the petitioner Mr. Rajib Ghosh, Adv. ...for the respondent The Court :- The present arbitration petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, seeking appointment of an Arbitral Tribunal comprising a sole Arbitrator to adjudicate the disputes between the parties arising out of an Agreement dated 12.01.2021. Learned Counsel for the parties, at the outset, state that the present disputes are governed by Soybean Processors Association of India (SOPA), having its Headquarter at Indore. Learned Counsel for the parties state that the SOPA has already forwarded the panel of the Arbitrators to the parties. The parties have chosen one Arbitrator each from the panel and that SOPA will further appoint the third presiding umpire arbitrator in accordance with its rule. In view of the fact that since SOPA has already initiated the process. 2 Learned Counsel for the petitioner seeks to withdraw the present petition. Accordingly, the same is dismissed as withdrawn with liberty to (SOPA) Soybean Processors Association of India to appoint the Arbitral Tribunal in terms of the Arbitration Clause contained in the Agreement dated 12.01.2021.
