(iii) To issue a writ/writs, direction/directions. Order/orders in the nature of Mandamus directing the
Patna High Court CWJC No.6345 of 2024(4) dt.15-07-2026 3/5 respondents to remove encroachment over the public Land and provide adequate protection to the petitioners and other Parcha Holders from the encroachers and their supporters. And/or Issue such other writ/writs, direction/directions or pass such other
order/orders which may be found just and proper in the facts and circumstances of the case. 3. Lots of water has flown down the ganges which include the appearance of the Deputy Collector Land Reforms, Rajgir as also the Circle Officer, Giriyak who were present in the Court on 15.06.2026 and they assure that once the petitioner appears before them, they shall look into the matter and see to it that their dispute free land is/are allotted to them so that they can live peacefully. 4. Today, on call, a counter affidavit has been provided by the learned State counsel on behalf of the respondent nos. 7 to 9 and learned State counsel has taken this Court to paragraph nos. 5 and 6 to show that despite the order was passed on 15.06.2026, the petitioner chose to approach the respondents on 09.07.2026. Still, they looked into the
Patna High Court CWJC No.6345 of 2024(4) dt.15-07-2026 4/5 matter and upon search, some piece of land bearing Khesra no. 583, 584 (area 31 decimal and 11 decimal respectively) under Khata no. 51 situated at Mauja-Kandopur, Thana no. 350 have been earmarked and further the revenue employees have been asked to search for other suitable lands. 5. The contention in the counter affidavit is that they are trying their best to get a suitable dispute free land in the vicinity as per the consent of the petitioner so that they are settled. 6. Taking into account the submissions, when the respondents are trying their best to get a dispute free land for the settlement of the land to the petitioner, it would be appropriate that the writ petition is disposed of directing them to do the needful and complete the process at an earliest and in no case beyond three months from the date of disposal of the order. 7. Failure to comply with the order and/or settle the land in favour of the petitioner within the time prescribed, the petitioner shall be free to file appropriate petition for initiation of contempt against the officers. Patna High Court CWJC No.6345 of 2024(4) dt.15-07-2026 5/5
8. The writ petition is disposed of with the aforesaid observation. Interlocutory Application, if any, stands disposed of. 9. If the petitioner fails to cooperate, an appropriate order be passed in the matter by the respondents. 2.
