The present petitions have been filed, inter alia, seeking directions to the Respondents to release compensation amount awarded to the respective Petitioners in terms of the Award No. 02/2012-13/DC(NW) dated 5th September, 2012. 3. The brief facts of the case are that a notification was issued under Section 4 of the Land Acquisition Act, 1894 (hereinafter “the Act”) for This is a digitally signed order. The said land included the subject lands of the respective Petitioners. 4. On 8th September, 2010 a declaration under Section 6 of the Act was issued, and thereafter, the Award was issued on 5th September, 2012. The Petitioners are stated to have repeatedly sought payment of the compensation from the Respondents, however, the same has not been paid. Accordingly, the Petitioners have been forced to file the present petitions. 6. While considering these matters on 8th August, 2025, the Court had noted that the short issue in these matters is in respect of payment of compensation and that there is no doubt as to the acquisition of the lands and This is a digitally signed order. The affidavit in terms of the previous order dated 24th November, 2025, has not been filed by the Land Acquisition Collector (hereinafter ‘LAC’). 8. The only reason given by Mr. Jha, ld. Counsel, for LAC is that there was an attachment of bank accounts of the LAC which led to a financial crunch due to which the payments have not been made. 9. Mr. Jha also submits that in fact in W.P.(C) 9250/2024, Rs. 1,21,68,632/- crores after deduction of TDS, has been paid to the Petitioner. However, interest has not been paid. The proof of payment of Rs. 1,21,68,632/- is taken on record as placed by the LAC. 10. In the opinion of this Court, there is no challenge to the entitlement of the Petitioners for compensation. Accordingly, let the compensation as applicable be released to all the Petitioners along with the interest as per law within a period of three months failing which penal interest @18% would be liable to be paid by the LAC. 11. According to the ld. Counsel for the Petitioner in W.P.(C) 9250/2024, the amount awarded was 1.45 crores, however, after deduction of TDS, only 1.21 crores has been released. There is a short payment of the awarded amount. Let the remaining amount be also released within three months. 12. All the petitions are disposed of in the above terms.
