This application is filed jointly on behalf of the Plaintiff and Defendant No. 1 under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between parties for grant of leave to the Plaintiff to withdraw the suit. 3. This suit is instituted on behalf of the Plaintiff inter alia seeking a decree of permanent and mandatory injunction against Defendant No. 1 and all others acting on its behalf to take down certain infringing videos allegedly containing unauthorized reproduction of Plaintiff’s copyright content as also restraining the said Defendant and all others acting This is a digitally signed order. During the pendency of the suit, parties have arrived at an amicable settlement incorporating the terms in a Settlement Agreement dated 20.11.2025 entered into between the Plaintiff and Defendant No. 1, copy of which is appended to the application. 5. Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of, recording the settlement between the parties. CS(COMM) 543/2024 & I.A. 32334/2024 6. In light of Settlement Agreement between the parties, terms of which bind the parties thereto, Plaintiff is permitted to withdraw the suit. 7. Suit stands disposed of as withdrawn along with pending application. 8. Plaintiff is held entitled to refund of entire court fees in accordance with the Court Fees Act, 1870.
