Saikia, learned counsel for the petitioner. Also heard Mr. K.K. Parasar, learned CGC appearing for the respondents. In the present writ petition, the petitioner, who is the first wife of the deceased, has raised a claim for being authorized family pension in pursuance to the death of her husband Nathuram Sarma who was a member of the CRPF and was imposed with penalty of compulsory retirement on the ground that he had committed misconduct by marrying more than once during his lifetime. The materials brought on record raises a dispute with regard to the very identity of the petitioner as the wife of late Nathuram Sarma. Further, there is also a dispute with regard to the status of the other wives of the ex-force personnel Nathuram Sarma. In view of the above position emanating in the matter, Mr. I.H. Saikia, learned counsel appearing for the petitioner submits that he be permitted to withdraw the present writ petition with liberty to the petitioner to approach Civil Court of competent jurisdiction to establish that she is the only wife of late Nathuram Sarma, Ex-Head Constable/ Armorer, CRPF and the marriage with the other projected wives was never solemnized by her deceased husband. In view of the above submission of the learned counsel for the petitioner, the present writ petition stands dismissed on withdrawal with liberty to the petitioner to approach civil court of competent jurisdiction for establishing her claim of being the only wife of late Nathuram Sarma and to be entitled to be authorized family pension by the respondents, herein.
