Sikdar, learned counsel for the applicants and Mr. B.J. Mukharjee, learned counsel for the opposite party. 2. This application, under Section 5 of the Limitation Act, is filed by the applicants for condonation of delay of 562 days in filing the connected civil revision petition. 3. Mr. Sikdar, learned counsel for the applicants submits that initially the applicants filed one appeal, being Title Appeal No. 01/2022, before the learned Civil Judge, Goalpara. But, the same was returned vide order dated 17.05.2023 and thereafter, the applicants have filed the connected civil revision petition and in that process the delay of 562 days occurred and the same has been explained in Page No.# 3/3 paragraph Nos. 4, 5 & 6 of the application. Mr. Sikdar further submits that the delay is not intentional, rather it is circumstantial and therefore, the said delay may be condoned and the civil revision petition may be admitted for hearing. 4. On the other hand, Mr. Mukharjee, learned counsel for the opposite party submits that he has no objection. 5. Accordingly, taking note of the submissions of learned counsel for both the parties and also considering the statements and averments made in paragraph Nos. 4, 5 & 6 of the application, the delay of 562 days in preferring the connected civil revision petition stands condoned. 6. In terms of above, this I.A. stands disposed of. 7. Now, the registry shall register the civil revision petition and list the same before the Court as soon as practicable. JUDGE Comparing Assistant
