AUGUST 24, 2026 1) Heard learned counsel for the petitioner and respondents. The petitioner has made following prayers in the present writ petition :-
“a) Issue writ, order or direction and thereby direct the respondent Nos.2 and 3 to decide the application for correction of name in date of birth certificate of petitioner No.2; b) Issue writ, order or direction to the respondent Nos.2 and 3 to correct the name in the date of birth certificate of petitioner No.2 and further be pleased to direct them to remove the name of Ubed Zamil Shaikh from the column of name of father in the said birth certificate of petitioner No.2 and the name of petitioner No.1 may kindly be included as a parent in the birth certificate of petitioner No.2. c) Grant any other relief in the facts and circumstances of the case, which this Hon’ble Court deems fit and proper in the interest of justice.” KOLHE 2026:BHC-NAG:11026-DB
2 40-wp 7101.2024.odt 2) Considering the prayer clauses, we are of the opinion that the purpose would be served if respondent No.3 is directed to treat the present petition as a representation of the petitioner and take a decision thereon within a stipulated period. 3) Accordingly, the writ petition is disposed of with a direction to respondent No.3 – the Registrar, Births and Deaths, Chandrapur Municipal Corporation, Tah. & Dist. Chandrapur, to treat the present petition as a representation of the petitioner and take a decision thereon within six weeks from the date of furnishing a copy of this order along with a copy of the petition. The decision on such representation shall be communicated to the petitioner within one week from the date of such decision.
4) If, for any reason, respondent No.3 is of the opinion that the grievance raised in the petition cannot be decided by him but can be decided by respondent No.2, then respondent No.2 shall take a decision thereon within the aforesaid stipulated period.
