G RAJU The Court made the following: 3 ORDER: This Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act, 1971 for willful, wanton and deliberate disobedience in implementation of the order passed by this Court on 01.08.2023 in W.P.No.10006 of 2023. 2. Aggrieved by the action of the respondents/contemnors in issuing the proceedings dated 20.02.2023 rejecting the requests made by the petitioner for pre-regularization of their services in terms of G.O.Ms.No.179, School Education (Prog.I) department, dated 18.11.2022, the petitioners filed W.P.No.10006 of 2023. This Court, on 01.08.2023, passed the following order: “3. In view of the same, for the reasons alike in the aforesaid order, this Writ Petition is also disposed of in terms of the common order dated 11.05.2023 passed by this Court in Writ Petition No.9381 of 2023 and batch. There shall be no order as to costs. ” 3. Heard learned counsel on either side. 4. Today when the matter came up for hearing, learned counsel representing the respondents/contemnors furnished a copy of G.O.Ms. No.7, School Education (Services.I) department, dated 13.04.2026 which is issued in compliance to the orders passed by this Court on 11.05.2023 in W.P.No.9381 of 2023 and batch followed by the W.A.No.256/2024 and batch, 4 W.A.No.808 and 817 of 2025 and other connected cases. The relevant portion of G.O.Ms.No.7, dated 13.04.2026 is extracted hereunder: “(i) count the pre-regularization service rendered by the Vocational Instructors who are covered in the above said WPs/Was and other connected cases, for the purpose of pensionary benefits under the Old Pension Scheme and to process all the pensionary benefits and the pension and other retirement benefits under the old Pension Scheme, in terms of G.O.Ms.No.179, School Education (Prog.I) Department, dated 18.11.2022 and (ii) consider to extending the said benefit as a one-time measure to all the similarly situated Vocational Instructors (who are not litigants), subject to: a) verification of eligibility and service records; b) applicability of conditions stipulated in G.O.Ms.No.179; c) restriction of benefit to pensionary purposes only.” 5. In view of the same, this Court is of the opinion that no contempt lies against the respondents/contemnors. Accordingly, this contempt case is closed. There shall be no order as to costs.
