The present application is filed with a prayer for withdrawal and transfer of H.M.O.P.No.22 of 2024 from the file of Civil Judge (Senior Division) Court, Kadiri to the file of Family Court, Gunter, Guntur District. 2. H.M.O.P.No.22 of 2024 is filed by the husband before the Civil Judge (Senior Division), Kadiri under section 9 of the Hindu Marriage Act with a prayer for restitution of conjugal rights. 3. Hard both sides. 4. Learned counsel for the petitioner would submit that the petitioner is a lady, the distance between Guntur to Kadiri is around more than 350 K.Ms., she has initiated a case for maintenance and also under the provisions of Protection of Women from Domestic Violence Act, both are pending at Guntur, husband is not paying the maintenance amount, and also it will be financially and physically difficult for her to travel to Kadiri from Guntur for attending the court, hence the matter may be transferred. 3 AHHS,J Tr.C.M.P.No.160 of 2024 Dated: 21.07.2026. 5. Respondent not filed counter but, orally opposed the application, contending that the petitioner has all sorts of income, on the point of jurisdiction the case was initiated before the court at Kadiri. 6. Upon considering the facts and circumstances of the case and the grounds:- i. The petitioner is a woman. ii. Even as per recitals in H.M.O.P.No.22 of 2024 filed by the respondent, address of the wife is shown at Gunturu, iii. The distance between Guntur and Kadiri is more than 350 K.Ms. iv. In matrimonial disputes, the place of wife’s residence is prima facie a forum convenience. v. Two other cases are pending at Guntur Courts between the parties. The prayer for the transfer of the case from Civil Judge (Senior Division) Court, Kadiri to the Family Court, Guntur District, is found convincing and the petition is allowed as follows:- i. The Civil Judge (Senior Division), Kadiri, it is directed to cause transmission of the record in H.M.O.P.No.22 of 2024 to the file of Judge, Family Court, Guntur, after duly indexed, forthwith. 4 AHHS,J Tr.C.M.P.No.160 of 2024 Dated: 21.07.2026. ii. The Judge, Family Court, Guntur District, is directed to dispose of the case according to law as early as possible and both parties shall co- operate for the same. iii. The presence of the respondent need not be insisted unless his presence is necessary for conciliation process and his evidence etc.,. 7. The Judge, Family Court, Guntur District is directed to explore the possibility of settlement through the conciliation process before proceeding with trial. 8. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. No costs.
