CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 21st July 2026 COMMON ORDER: (per Hon’ble Sri Justice Challa Gunaranjan) Writ Petition Nos.10539 and 30891 of 2024 have been preferred challenging the orders dated 21.07.2023 in LCC No.1517 & 1518/KVR/75, passed 1st respondent, accepting the declarations filed by the tenants to be illegal and contrary to the provisions of A.P. Land Reforms (Ceiling on Agricultural Holdings) Act, 1973.
2. Petitioners in Writ Petition No.10539 of 2024, have also filed Writ Petition No.15410 of 2024 questioning the action of respondent police in trying to evict them at the instance of the unofficial respondents under the grab of providing police aid
2 HCJ & CGR, J W.P. Nos.10539, 15410 & 30891 of 2024 without following due process of law to be arbitrary, illegal and without jurisdiction.
3. All these writ petitions concern the lands which are subject matter of proceedings in LCC No.1517 & 1518/KVR/75, against which appeals are pending before Land Reforms Appellate Tribunal. Writ petitioners essentially claim to be landowners and whereas the respondents opposing them assert their rights as tenants with reference to the earlier litigation, which ended in their favour and got sealed by virtue of judgment of Hon’ble Apex Court.
4. Since the substantial proceedings by way of appeal are pending before Land Reforms Appellate Tribunal and in view of the dismissal of Writ Appeal No.241 of 2024 by us today vide separate
order, petitioners are relegated to appellate authority with liberty to raise all the issues even those that are sought to be canvassed in these writ petitions for proper adjudication.
5. Aforesaid course of action is suggested in view of the order passed in Writ Petition No.5458 of 2024, dated 05.03.2024 by learned Single Judge.
6. Accordingly, these writ petitions stand disposed of. No costs.
