Nil.09.2024 and, b. further not clarifying that primacy shall be given to the said cut-off date i.e.16.04.2024, the same shall be sacrosanct and further explicit exemption given vide order dt.03.10.2024 in W.P.No.22147 of 2024 by this Hon’ble High Court of Andhra Pradesh or to be taken up and given by this Hon’ble High Court of Andhra Pradesh, shall be for the purpose of filling the vacant seats, if any, upon allotting the seats in Phase I is illegal, arbitrary and against the rights protected under the constitutional law and against the rules and guidelines in vogue and consequently direct the 2nd respondent university to issue the merit list basis the cut-off date as 2 HCJ & CGR, J WP_22764_2024 Whether the order is Speaking/Reasoned : Yes / No Whether the order is Reportable : Yes / No 16.04.2024 in terms of the notification dt.27.09.2024 and prepare a separate list for the candidates, who have taken a specific exemption from this Hon’ble High Court of Andhra Pradesh, and primacy shall be given to the candidates who are qualified in terms of the said notification and the candidates so eligible through the directions of this Hon’ble High Court shall be considered for allotting the seats in further rounds of counselling (subject to availability of the seats), if any, ….” 2. Learned counsel for petitioners, at the outset, submits that cause of action no longer survives as both the petitioners as well as respondent No.4 have got admission subsequent to interim order dated 04.10.2024, passed in this writ petition and are pursuing with their course. 3. Learned counsel for respondent No.2 affirms the above and raises no objection to their continuing with the course. 4. Writ Petition is accordingly disposed of as infructuous.
