Mr. V. Kumar, the learned counsel appearing on behalf of the petitioner submits that he has instructions to withdraw the instant writ petition. He, however, submits that the withdrawal of the instant writ petition should not preclude the petitioner to file a fresh writ petition claiming pensionary benefits.
2. The instant writ petition is filed challenging the discharge order. The challenge to the discharge order and the claim for pensionary benefits being separate, the withdrawal of the instant writ petition shall not preclude the petitioner to avail such remedies.
3. Accordingly, the instant writ petition stands closed on withdrawal without prejudice to the petitioner’s rights to file a fresh writ petition claiming pensionary benefits, if so permissible under law.
