...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ or Direction declaring the action of the Official Respondents in not considering the representation of the Petitioner dated 14/02/2024 and 17/11/2023 made before the 2nd to 4th Respondents, to take action against the unofficial Respondents for violating the order of the 4th Respondent/Tribunal dated 17/12/2022 and threatening the Petitioner with dire consequences and not allowing to live in the house permitted by the Tribunal vide order dated 17/12/2022 as illegal, arbitrary and against the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and consequently direct the Respondent Nos.2 to 5 to implement the order of the Tribunal dated 17/12/2022 passed in O.P. ORDER:
The present Writ Petition is filed to direct the respondent Nos.2 to 5 to take action against the unofficial respondents to implement the orders of the Tribunal dated 17.12.2022, passed in O.P. No.44 of 2022, on the file of the 4th respondent-Revenue Divisional Officer-cum- Chairman, Maintenance and Welfare of Parents and Senior Citizens Tribunal (for short, hereafter called as Senior Citizens Act, 2007)
2. The 4th respondent vide order dated 17.12.2022 directed the unofficial respondents herein to pay an amount of Rs.60,000/- per month towards maintenance of the petitioner apart from rents derived from the lease of the properties.
3. Under Rule 20 of the Andhra Pradesh Maintenance of Parents and Senior Citizens Rules, 2011, the District Magistrate is the competent authority to ensure the implementation of the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
4. According to Section 27 of the Senior Citizens Act, 2007, Civil Court jurisdiction is barred in respect of anything which is done or intended to be done by or under Section 27of the Act.
5. Unofficial respondent Nos.6 and 7 filed counter affidavit, and it is asserted that the respondents are inclined to give undertaking that they will take care of their parent, if the senior citizen resides along them and

they will provide all the necessities and also further undertakes that they will pay Rs.60,000/- per month thorough bank account, only after cancelling registered lease deed vide document No.5698 of 2022, dated 15.09.2022
6. Therefore, the present Writ Petition is disposed of directing the 2nd respondent herein to dispose of representation dated 14.02.2024 as per law. Before taking any action, the 2nd respondent is directed to issue notice to the writ petitioners in W.P. No.19047 of 2025 who are arrayed as respondent Nos.6, 7 in W.P. No.8286 of 2024, for considering their objections. Needless to say that the 2nd respondent is
directed to pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of the order. There shall be no order as to costs.
