1. Heard learned Counsel Ms. P. Borthakur for the applicant insurance company and learned counsel Mr. R.Goswami for opposite party No.1.
2. An affidavit relating service of notice through paper publication to opposite party No. 3 in connection with I.A. (Civil)/377/2024 and opposite party No. 6 in connection with I.A. (Civil)/3566/2023 is on record.
3. These interlocutory applications under Section 5 of the Limitation Act 1963 have been filed for condonation of delay of 56 days in filing the connected Appeal in connection with MAC Case No. 32/2014 and MAC Case No. 33/2014 respectively against the Judgment and Award dated 17.05.2023 passed by the learned Member, MACT No.2, Kamrup(M).
3. It is submitted by the applicant that the delay was not intentional but was a result of forwarding the decision of the aforesaid MAC Cases to the head office.
4. The learned counsel for opposite party No.1 has no objection if the delay is condoned.
5. I have considered the submission at the bar with circumspection. No malafide could be deciphered. Accordingly delay of 56 days is hereby condoned.
