The petitioner is seeking to file an appeal against acquittal vide judgment and order dated 24-04-2024, passed by learned Additional Sessions No. 5, Kamrup(M), Guwahati in Criminal Appeal 287/2017 – whereby the judgment of the trial court convicting the respondent No. 2 for criminal defamation and sentencing him with fine – was set aside with an order of acquittal. 3. The learned counsel for the petitioner submits that there was no sufficient justification to overturn the trial court judgment and that the petitioner wants to assail the appellate judgment passed in appeal. 4. The learned counsel for the respondent No. 2 objects to grant of leave. 5. Perused the leave petition. 6. The prayer for leave is allowed and accordingly, the petitioner is granted leave to prefer the appeal against acquittal. 7. Leave petition is allowed and disposed of.
