Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in non- payment of amounts Rs. 1,54,614/- after finalizing the bills payable to the petitioner after the successful completion of the execution of two different Irrigation works i.e., Desilting and bund strengthening of Krishnamma (PR) Tank and Filling of SC Community Site and BC Grave Yard in Jagannadhapuram Village of Nallajerla Mandal in West Godavari District under Neeru- Chettu programme duly approved by the respondents, as illegal, arbitrary, unjust, unreasonable and Violative of articles 14 and 21 of Constitution of India and consequently direct the respondents to pay amounts due to the petitioner along with interest in respect of execution of said works forthwith and to pass IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased May be pleased to direct the respondents to pay the amounts Rs.

The above writ petition was filed to declare the action of the respondents in not paying the amount in relation to the works executed by the petitioner, as illegal and arbitrary. Page 3 of 4
2. Today, when the matter is taken up for consideration, Sri Shaik Jahangeer Basha, learned counsel representing Smt. Nimmagadda Revathi, learned counsel for the petitioner would submit that pending the writ petition, the amount was paid to the petitioner by the authorities. Hence, the cause in the writ petition does not survive and the writ petition has become infructuous. 3. Recording the submission made by learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. No order as to costs.
