1. Matter comes upon an application for vacation of interim
order dated 02.12.2024. Vide the said order, the respondents were although permitted to continue with the departmental inquiry but were restrained from passing any final adverse order.
2. Counsel for the respondents submits that the departmental proceedings have now been completed but the final order could not be passed because of the interim order. He submits that the
(2 of 2) [CW-18111/2024] criminal proceedings are pending since the year 2016 and the disciplinary proceedings cannot be kept in abeyance till the conclusion of the criminal proceedings which are proceeding at a snail's pace.
3. Counsel for the petitioner however submits that it is not at the behest of the petitioner that the criminal proceedings have been delayed. He submits that the matter is at the stage of prosecution evidence and the proceedings would be concluded soon. Till then, interim order dated 02.12.2024 deserves to be continued.
4. In view of the submissions made, the present writ petition is
disposed of with a request to the learned Criminal Court to conclude the criminal proceedings expeditiously, preferably within a period of one year from now.
5. The final order qua the disciplinary proceedings shall not be passed till the said date. However, if the criminal proceedings are not concluded within a period of one year, the respondents shall be at liberty to pass final order in the disciplinary proceedings.
6. Application under Article 226(3) of the Constitution of India and the stay petition stand disposed of.
7. Pending applications, if any, stand disposed of.
