1. The instant misc. application has been filed by the applicant for recalling the order dated 18.07.2023 passed by this Court while deciding the S.B. Civil Writ Petition No. 11729/2014.
2. Counsel for the applicant submits that the aforesaid writ petition was disposed of by this Court in a batch of writ petitions vide order dated 18.07.2023 as the respondent-University agreed to grant him the benefits but all the benefits have not been granted. Hence, the matter is required to be decided on its merit.
3. Per contra, learned counsel for the respondents opposed the
arguments raised by counsel for the applicant and submitted that
(2 of 2) [WMAP-123/2024] benefits pertaining to the post absorption has already been granted to the applicant. He further submitted that the remaining benefits are required to be granted by the State Government only upon its approval and as no such approval has been granted by the State Government.
4. Heard and considered the submissions made at Bar and perused the material available on record.
5. Considering the arguments raised by counsel for the applicant and looking to the fact that the desired benefits have not been extended to the applicant by the University for whatever reasons, the matter is required to be heard and decided on its merit.
6. Looking to the overall facts and circumstances of the case and the reasons stated therein, the application stands allowed. The order dated 18.07.2023 passed by this Court stands recalled only to the extent of S.B. Civil Writ Petition No. 11729/2014. The S.B. Civil Writ Petition No. 11729/2014 is ordered to be restored to its original umber.
