The Court made the following order:
This Contempt Case is filed under Sections 10 to 12 of Contempt of Courts Act, 1971 against the respondents for willful disobedience of the order dated 18.04.2024 passed by this Court in Writ Petition No.33358 of 2023. 2. Heard Sri Mangena Sree Ramarao, learned counsel for the petitioner, Smt Sireesha Rani Vallabhaneni, learned counsel for respondent No.1 and Sri Posani Venkateswarlu, learned senior counsel appearing for respondent No.2. 3. Sri Mangena Sree Rama Rao, learned counsel for the petitioner, submitted that pursuant to the filing of the Contempt Case, the authorities have removed the encroachments, and therefore, it amounts to compliance with the order of this Court dated 18.04.2024 in Writ Petition No.33358 of
2023.
However, the petitioner apprehends that after closure of the Contempt Case, the authorities may again permit encroachments, accordingly prayed to pass appropriate orders. 4. Since the respondent authorities have removed the encroachments, even according to the petitioner, there is nothing survives for further adjudication and the Contempt Case is liable to be closed. The contention advanced by the petitioner is mere apprehension and such apprehension cannot be taken note of by this Court, as apprehensions alone are not sufficient for adjudication. 4
6. Accordingly, the Contempt Case is closed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any in the Contempt Case, shall stand closed. ___________________________ JUSTICE RAVI CHEEMALAPATI 08.05.2026 MP
