Report submitted by the State does not respond to the order dated April 9, 2026. However, since it is evident from the report of the Revenue Inspector Gram Panchayat No.I, Bhagwanpur-II dated 3rd August, 2023 that 70-80% of the water body has been illegally filled up and illegal/unauthorized construction has been raised in plot no.1251, recorded as ‘Doba’, the Sub-Divisional Officer, Contai, being the 3rd respondent herein, is directed to take necessary steps on the basis of the report submitted by the Revenue Inspector upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. 2 In the event any illegal/unauthorized construction is found on the land in question, the concerned authority shall take necessary steps in accordance with law. The entire exercise shall be completed by the 3rd respondent within eight weeks from the date of communication of this order. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
