THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.23761 OF 2024 ORDER:
1. This writ petition is filed under Article 226 of the Constitution of India, to issue writ of mandamus declaring the action of Respondent Nos.2 & 3 in not issuing the application form to the petitioner society to submit a detailed project report to start School of Nursing as illegal and violative of Articles 14 and 19(1)(g) of the Constitution of India and consequently direct Respondent Nos.2 & 3 to issue application form to the petitioner forthwith, to submit the same along with the detailed project report to start the School of Nursing. 2. The petitioner’s grievance is that Respondent Nos. 2 and 3 have failed to issue an application form to the petitioner society for submission of a detailed project report to establish a School of Nursing, in violation of Articles 14 and 19(1)(g) of the Constitution of India. The petitioner, a society intending to establish a Nursing School to impart the General Nursing and Midwifery (GNM) course, has repeatedly requested the issuance of the application form. 2 Despite such requests, the respondents have neither provided the application form nor responded, necessitating the filing of the present writ petition. 3. On the other hand, the learned Government Pleader for Medical & Health, upon written instructions dated 15.04.2026, submitted that the writ petition may be disposed of with a direction to the petitioner to approach Respondent No. 3 within two weeks from the date of the order. Upon payment of the prescribed application fee through a Government challan, Respondent No. 3 shall issue the application form. The petitioner shall thereafter duly fill and submit the same along with all relevant documents, and Respondent No. 3 shall scrutinize the application and dispose of it in accordance with the applicable rules. 4. In view of the submission made by the learned Government Pleader for Medical & Health and pursuant to the written instructions dated 15.04.2026, and without expressing any opinion on the merits of the case, the writ petition is disposed of, directing the petitioner to approach Respondent No. 3 within a period of two (2) weeks from the date of receipt of a copy of this order.
Upon the petitioner approaching Respondent No. 3 and remitting the

3 prescribed application fee through a Government challan, Respondent No. 3 shall, in accordance with law, issue the requisite application form to the petitioner. Thereafter, the petitioner shall duly fill in the application form and submit the same along with all relevant documents to Respondent No. 3. On receipt of such application, Respondent No. 3 shall scrutinize the same and pass appropriate orders in accordance with the applicable rules and regulations, within a reasonable period. 5.
