HON'BLE MR. JUSTICE ANAND SHARMA
Order 18/02/2026
1.
Learned counsel for the petitioner submits that the petitioner has challenged the order dated 19.07.2024, whereby person junior to the petitioner has been promoted on the post of Administrative Officer. Learned counsel submits that only on account of the fact that the petitioner does not possess degree of graduation, he was not considered for promotion.
2.
Learned counsel for the respondents submits that candidature of the petitioner was considered strictly as per Rule
(2 of 2) [CW-13024/2024] and since, the Rules provide for possessing degree of graduation for consideration of promotion on the post of Administrative Officer, hence, there is no infirmity in the action of the respondents.
3. Thereupon, learned counsel for the petitioner submits that there is a provision of relaxation in Rule 3 of Rajasthan State Road Transport Corporation (RSRTC) Employees Service Regulations, 1965 (for short ‘the Regulations of 1965’). However,
learned counsel for the petitioner is unable to show that any point of time, the petitioner has submitted any application for seeking relaxation in the qualification.
4. In view of above, this Court deems it just and proper to dispose of this writ petition with liberty to the petitioner to submit a representation in the light of Rule 3 of the Regulations of 1965 before the Competent Authority for granting relaxation in qualification for the purpose of promotion on the post of Administrative Officer.
5. In case, any such representation is received by the respondents, the Competent Authority shall consider and decide the same within a period of six weeks from the date of receipt of representation along with certified copy of this order.
6. It is made clear that this Court has not expressed any opinion on merits of the case.
7. Pending application(s), if any, stand(s) disposed of.
