PUBLIC PROSECUTOR (AP) The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to quash the proceedings against the Petitioner Nos.1 to 4/Accused Nos.2 to 5 in C.C.No.440 of 2023 on the file of the learned Judicial First Class Magistrate, Giddalur (for brevity, ‘the learned Trial Court)’. 2. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. 3. On perusal of the record, Petitioner Nos.1 and 2/Accused Nos.2 and 3 are the parents of Accused No.1. Petitioner No. 3/Accused No.4 is the sister of Accused No.1, and Petitioner No.4/Accused No.5 is the maternal uncle of Petitioner No.1. Respondent No.2 has lodged a complaint against the Petitioners and other accused for the alleged offence punishable under Section 498‑A of the Indian Penal Code, 1860 (for brevity, ‘the I.P.C.’). The police, after thorough investigation, filed a charge sheet numbered as C.C.No.440 of 2023, which is pending on the file of ‘the learned Trial Court.’

4. In the course of hearing, this Court appointed Mr. D. Kishore Kumar as Mediator to facilitate reconciliation between the Petitioners and Respondent No. 2.
The mediation proceedings were duly conducted in the presence of both parties, and after detailed discussions, the parties arrived at an amicable settlement. The Mediator thereafter submitted his report to this Court, which bears the signatures of Respondent No. 2 as well as the Petitioners, thereby evidencing their voluntary participation and consent. In the Mediator’s report, it is specifically recorded that Respondent No. 2 and Accused No. 1 have resolved their differences, expressed their desire to continue their marital relationship, and agreed to withdraw all pending cases filed against each other. 5. Considering the Mediator’s report, the proceedings in C.C.No.440 of 2023 on the file of ‘the learned Trial Court’ against the Petitioners/Accused Nos.2 to 5 are hereby quashed. 6.
