The Court :- This is an application for grant of letters of administration with the last Will and Testament dated 10th Decemaber, 2021 left behind by the above named deceased annexed thereto. One of the heirs-in-intestacy of the testator, namely Rupali Chakraborty as stated in the application for grant is suffering from down syndrome-cerebral palsey-40% mentally retarded as has been certified by the Government Medical Doctor to be a special child. It is also the case of the applicant as stated in paragraph 8 of the petition, the said Rupali Chakraborty is unable to manage herself and as such stays with her elder sister Sonali Mukherjee being the applicant for letters of administration with the Will annexed. The Will also provides for a life interest of Rupali in premises No. 5/7, Jessore Road, Dum Dum, Kolkata 700028. The mother and wife of the testator predeceased him. The elder daughter, Sonali Mukherjee, is the applicant and the only son, Abhijit Chakraborty, and the younger daughter, Rupali Chakraborty, have consented 2 to the grant. Rupali has filed a consent affidavit affirmed before the Oath Commissioner in this Court House. Subject to such condition of life interest of Rupali at premises No. 5/7, Jessore Road, Dum Dum, Kolkata 700028, letters of administration is granted to the applicant on the Will having been proved in common form by the affidavit of one of the attesting witness to the same. Considering the view of the department upon complete scrutiny, the application for grant of letters of administration is allowed by granting order in terms of prayer (a) of the petition subject to the applicant furnishing a personal bond for a sum of Rs.22,00,000/- with two sureties.
