PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to quash the proceedings against the Petitioner Nos.1 to 3/Accused Nos.1 to 3 in F.I.R.No.92 of 2024 on the file of Disha Urban Police Station, Guntur District, for the alleged offences punishable under Sections 498-A, 509, 420, 341, 352 and 506 read with 34 of the Indian Penal Code, 1860 (for brevity, ‘the I.P.C.,’) and Section 156 (3) of ‘the Cr.P.C’. 2. Heard Sri P.Narasimha Rao, the learned counsel for the Petitioners, Mrs.S.Samantha, the learned counsel appearing for Sri.G.Ronald Raju, learned counsel for Respondent No.3, and Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor. 3. On perusal of the record, the Investigating Officer, after thorough investigation, has filed a Charge Sheet deleting the names of the in-laws, i.e., Accused Nos.2 and 3 of Respondent No.3. The learned counsel for 3 Respondent No.3 submits that a protest petition has been filed against the findings of the Investigating Officer in the Charge Sheet. The learned counsel for both sides further submits that the protest petition is still pending. 4. After filing of the Charge Sheet, Petitioner No.1 has not challenged the Charge Sheet. Respondent No.3, however, has filed a memo appending the Charge Sheet. Petitioner No.1 is required to challenge the Charge Sheet, but has not done so thus far. The protest petition against Petitioner Nos.2 and 3 is still pending. 5. Therefore, the Criminal Petition is disposed of granting liberty to Petitioner No.1 to challenge the Charge Sheet, if so advised. The learned Jurisdictional Magistrate concerned is directed to expedite the hearing of the protest petition, if it is pending, filed by Respondent No.3 and to pass appropriate orders within a reasonable time, preferably within a period of three (03) months, and submit a report to the Registrar (Judicial). 6.
