15.04.2026 (The matters have been taken up today, as 14.04.2026 was declared as a holiday on account of birthday of Dr. B.R. Ambedkar.)
1. The Status Report on behalf of the Public Works Department (PWD) has been handed over during the course of hearing which states as under:
“2. That in October 2025, the Rohtak Road (NH-09) from Punjabi Bagh Underpass to Tikri border was handed over to the National Highways Authority of India (NHAI) wef 01.11.2025 vide Letter No. 27.10.2025. The handover road includes area having Metro Pillar No. 299 to 298 which forms the subject matter of the present petition.
The condition of handover was that the works which were in progress would be handed over to NHAI separately after completion. Hence, the work involving the construction of Foot-over-Bridge near Metro Pillar No. 299 to 298 was This is a digitally signed order. to be handed over by PWD after completion of the same. The copy of the letter dated 27.10.2025 has been annexed as ANNEXURE A-1. 3. That, however, in March 2026, the contract with the contractor was foreclosed by the Executive Engineer, PWD (Division West Road) PWD vide letter dated 03.03.2026 under Clause-13 of the agreement. The copy of the letter dated 03.03.2026 has been annexed as ANNEXURE A-2. 4. That consequently, the work is no longer currently being carried out by the Answering Respondent and the structure and/or dismantled material will either be handed over to NHAI or reused within the Answering Respondent Department. Accordingly, the issue raised by the Petitioner currently does not subsist.”
2. It is thus seen that on account of foreclosure of the contract with the contractors, the construction work has been stopped. Since, the work is no longer currently being carried out and the structure or dismantles material will either have to be handed over to the National Highways Authority of India (NHAI) or reused within the respondent department, therefore, there is no reason to keep these writ petitions pending. 3. The Court, however, finds that the petitioner may make a representation to the NHAI or the PWD department requiring them to take decision with respect to dismantles material, either it be handed over to the NHAI or to be reused. 4. If such a representation is made, let the same be decided with due expedition. 5.
If the grievance of the petitioner is not mitigated within a reasonable period of time, the petitioner shall be at liberty to take appropriate recourse. 6. With these observations, the instant petitions along with pending applications stand disposed of. PURUSHAINDRA KUMAR KAURAV, J APRIL 15, 2026/SH This is a digitally signed order.
