Mahira, learned counsel appeared on behalf of the petitioner and Mr. Shyam Sharma, learned GA appeared on behalf of the respondents. [2] At the outset, learned counsel appearing for the petitioner submitted that the present writ petition can be disposed of by issuing a simple direction to the respondents to consider and dispose of – (i) Eviction Case No. 1 of 2021 in the Court of Sub-Divisional Officer, Lamphel (at Annexure – A/2) (ii) Application dated 07-07-2022 submitted to the Deputy Commissioner, Imphal West (at Annexure – A/7) and (iii) Application dated 06-09-2022 submitted to the Commissioner/ Secretary (Revenue), Government of Manipur and the Deputy Commissioner, Imphal West, Manipur (at Annexure – A/8) [3] Mr. Shyam Sharma, learned GA appearing for the respondents fairly submitted that he has no objection. The learned GA, however, submitted that while issuing such directions to the respondents, a rider may be added that the consideration and disposal of the Eviction Case as well as the Applications mentioned above should be done strictly in terms of the applicable provisions of law. [4] After considering the submission made by the learned counsel appearing for the parties and on perusal of the record, this -2- WP(C) No. 75 of 2024 Contd.../- court is of the considered view that it will serve the interests of justice to issuing the following directions:- (i) The Sub-Divisional Officer, Lamphel (respondent No. 3), is hereby directed to consider and dispose of the Eviction Case No. 1 of 2021 pending before him strictly in terms of the applicable law; (ii) The Deputy Commissioner, Imphal West, is hereby directed to the consider the application dated 07-07-2022 submitted by the petitioner on its own merit strictly in terms of the applicable law and to dispose of the same by issuing a speaking order; (iii) The Commissioner/ Secretary (Revenue), Government of Manipur and the Deputy Commissioner, Imphal West are hereby directed to consider the application dated 06-09-2022 submitted by the petitioner on its own merit and strictly in terms of the applicable law and to dispose of the same by issuing a speaking order; (iv) It is made clear that the aforesaid directions given above should be carried out by the respondents within a period of four months from the date of receipt of a certified copy of this order; and -3- WP(C) No. 75 of 2024 Contd.../- (v) It is also made clear that the aforesaid directions have been issued without touching upon the merit of the present writ petition. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda -4-
