The respondent-wife as petitioner earlier filed Civil Proceeding No.433 of 2019 under Section 9 of the Hindu Marriage Act, 1955 before the Court of learned Judge, Family Court, Berhampur, Ganjam for restitution of her conjugal rights with the appellant-husband. The same was decreed on contest against the impugned judgment dated 26.06.2024. p. 2 3. Being aggrieved with the said judgment dated 26.06.2024, the appellant-husband preferred this matrimonial appeal. 4. Learned counsel for the appellant-husband has filed a memo dated 12.01.2026, which is at ‘Flag-B’, stating therein that the appellant-husband wants to withdraw this appeal. 5. As the appellant-husband does not want to pursue further the present proceeding, this appeal stands dismissed as withdrawn. 6.
