This common order will now give a closure to the captioned 2(two) CRPs and captioned MCs thereat. Though it is a case of withdrawal albeit with liberty, as the matter has to now continue in said Trial Court, this Article 227 Court deems it appropriate to make an order a little in detail. [3]
In the hearing today, revision petitioner Shri Thoudam Indrakumar Singh (@ Th. Indramani) was present instructing his counsel on record Mr. Md. Abdul Baqee Khan. On behalf of Mr. Md. Abdul Baqee Khan, learned senior counsel Mr. N. Jotendro, was in Court. To be noted, Mr. A. Surendrakumar Singh and Mr. Salam Yaiskul Singh, who are counsel on record for the revision
petitioner in the said Trial Court in the said suit are also present in Court (physical Court). [4]
As regards the respondents, the 2nd respondent Shri Nongthombam Beikul Singh has been deleted by way of a judicial order made by predecessor being order dated 18.07.2024 made in MC(CRP(CRP.Art.227)) No. 32 of 2024. As regards the 3rd respondent i.e., ‘the Sub Deputy Collector, Imphal West, Wangoi’ (‘said SDC’ for the sake of brevity), this official respondent has been deleted vide judicial order dated 05.03.2024 made by predecessor in main CRPs. This leaves the captioned CRPs and captioned MCs with a lone respondent and the lone respondent is Smt. Khumanthem Purnimashi Devi, who was originally 1st respondent when the CRPs were filed. On behalf of now lone respondent, Mr. Th. James, learned counsel along with Mr. W. Christopher Meitei, learned counsel on record are present in Court (physical Court).

After the matter was heard for some time, as it came to light that the revision petitioner has filed said suit in said Trial Court inter alia with prayers for declaration of title besides laying challenge to mutation order dated 10.06.2022 and demarcation order dated 20.06.2022 both made by said SDC. On instructions from revision petitioner who is present in Court (physical Court),
learned counsel on record for revision petitioner Mr. Md. Abdul Baqee Khan sought leave of this Court to withdraw the captioned CRPs and captioned MCs thereat but made a prayer to preserve all the rights and contentions of the revision petitioner to canvas all points (including points raised in captioned CRPs) in the said suit in said Trial Court. In this regard, this Court verified the
e-Court website of said Trial Court and it is seen that the said suit as well as said Judl. M.C. thereat are pending and the same are next scheduled to be listed on ensuing Saturday i.e., 20.06.2026 in said Trial Court. [6]
Be that as it may, Mr. Th. James, learned counsel and Mr. W. Christopher Meitei, learned counsel on record for lone respondent, consented for preservation of rights and contentions while permitting revision petitioner to withdraw the captioned CRPs and captioned MCs thereat. In this regard, a scanned reproduction of the endorsements made in the case files by the revision petitioner, counsel on record for revision petitioner Mr. Abdul Baqee Khan and Mr. Th. James, counsel on record for lone respondent are as follows:

The afore-referred scenario now means that the impugned orders in the captioned CRPs being 2(two) separate orders, both dated 08.01.2024 made in Revenue Revision Case Nos. 44 & 45 of 2022 on the file of Revenue Tribunal, Manipur at Lamphelpat, will remain and the same can be pressed into service by both sides in the said suit as well as in said Judl. M.C. Though obvious, this Article 227 Court makes it clear that it has not expressed any view or opinion on the merits of the matter, all questions are left open for the said Trial Court to decide and all rights and contentions of both sides i.e., revision petitioner/plaintiff and respondent/defendant are left open for being canvassed in the said Trial Court in said suit. The said Trial Court is requested to decide the matter on its own merits and in accordance with law. The learned Presiding Officer of said Trial Court is also requested to dispose of the said suit as expeditiously as the official business of the said Trial Court would permit.

Captioned the 2(two) CRPs and 2(two) MCs thereat are disposed of as withdrawn albeit with preservation of rights and contentions of both sides in the afore-referred manner and observations as set out above. There shall be no order as to costs. CHIEF JUSTICE Indrajeet
