This matter is taken up through hybrid mode.
2. Mr. Pujari, learned Counsel for the Petitioner submits, impugned is the order dated 21.04.2023 passed by the learned Judge, Family Court, Nayagarh in I.A. No.39 of 2022, arising out of Civil Proceeding No.102 of 2022, which was preferred by the present Petitioner-husband for a decree of divorce under Section 13(1)(i)(iii) of the Hindu Marriage Act, 1955. He further submits, as per the instruction received, in the meantime, the judgment has been pronounced by the learned Judge, Family Court, Nayagarh in Civil Proceeding No.102 of 2022 on 23.10.2025, thereby allowing the prayer of the Petitioner- husband, followed by a decree of divorce on the ground of adultery, as pleaded and proved in the said proceeding.
3. Mr. Pujari, learned Counsel for the Petitioner files a Memo enclosing thereto photocopy of the judgment dated
23.10.2025 passed in Civil Proceeding No.102 of 2022, which is taken on record.
4. Mr. Nayak, learned Counsel for the Opposite Party- wife does not dispute the said submission made by learned Counsel for the Petitioner.
5. Accordingly, the writ petition stands disposed of as infructuous.
6. It is made clear that, if the Opposite Party has any issue regarding recovery of the interim maintenance passed during pendency of C.P. No.102 of 2022, she may avail the appropriate remedy in accordance with law.
