ORDER 06.11.2024
01. This Court vide Order dated 14th October, 2024, granted last and final opportunity of two weeks to the respondents to comply with the Order/Judgment dated 10th July, 2023, passed by this Court in WP (C) No. 329/2023 in its letter and spirit by reflecting that the admitted amount to the tune of Rs. 9,00,44,358 (nine crore, fourty four thousand, three hundred fifty eight) along with interest stands transferred in the account of the petitioner, failing which, it was observed that this Court will be constrained to frame rule against the respondents 1,5 and 6, besides ordering for the personal presence of aforesaid respondents/contemnors. 02. Today, when the case was taken up in the pre-lunch-session, it was brought to the notice of this Court by the learned counsel for the petitioner that the order passed by this Court mentioned supra was not complied with and even the respondents 1,5 and 6 were not present in person. However, Law Officer from the Admisntrative Department of i.e. , PW R&B Department was present in person
and he was directed to comply with the aforesaid order. Accordingly, the matter was directed to be taken up in post-lunch- session. 03. When the instant contempt petition was taken up in post-lunch- session, Mr. Jahangir Ahmad Dar, GA, has provided a copy of the communication issued by the concerned Executive Engineer. A perusal whereof reveals that bill for an amount of Rs. 9, 00,44000/- has been remitted to the concerned treasury. However, from the bare perusal of the aforementioned communication, it is apparently clear that the interest component has not been paid in favour of the petitioner in terms of Judgment dated 10th July, 2023, passed by this Court in WP(C) No. 329/2023, which has assumed finality. Let the same be done by the respondents within a period of four weeks from the date a copy of this order is served upon them. A copy of the communication produced by Mr. Jahangir Ahmad Dar, GA, in the open Court is taken on record. 04. In the light of aforesaid development, there remains nothing further to be adjudicated upon in the instant contempt petition. Accordingly, the proceedings are closed. Rule, if any, framed shall stand discharged. 05. Petitioner is given liberty to revive the contempt petition in case the interest component as directed hereinabove is not released in his favour.
