By way of this execution petition, the petitioners are praying for the execution of the judgment passed by this Court in CWPOA No.3157 of 2019. 2. When this case was listed on 13.10.2025, the following order was passed:-
“When the matter was taken up for consideration today, learned Senior Counsel appearing for the petitioners submits that though the Recruitment & Promotion Rules stand framed in terms of the judgment passed and the petitioners have also been conferred seniority, but the same is confined to the intra seniority between DPEs only, who now stands designated as Lecturers, their fear is that when their turn will come for
2 promotion they will be ignored because they are not included in the consolidated seniority list of the Lecturers. On the other hand, learned Advocate General submitted that the judgment stands complied with in letter and spirit. The seniority of the petitioners stands determined and they will be considered for promotion for the next promotional post strictly in terms of their seniority as it stands determined, vis-a-vis the consolidated list of the Lecturers. Meaning thereby that eligibility for promotion shall be dependent upon seniority as Lecturers, be it the seniority list of the present petitioners or the list of the combined Lectures. Let an affidavit in this regard be filed by the next date of hearing by Secretary Education, to the Government of Himachal Pradesh. List on 03.11.2025.”

In light of the statement made by learned Advocate General, this Court is of the considered view that no further order is required to be passed in the execution petition save and except that benefit be conferred upon the petitioners in terms of the judgment as well as the statement of learned Advocate General, as it stands recorded on 13.10.2025 for the purpose of promotion to the higher post. 4.
At this stage, learned Senior counsel for the petitioners submits that liberty be granted to the petitioners to approach the Court afresh in case they still feel aggrieved on account of non-compliance of the judgment passed by the Court. 3
5. In view of the above, the petition stands disposed of with liberty as prayed for, so also pending miscellaneous applications, if any. (Ajay Mohan Goel)
