The challenge in this appeal is made to the judgment and order dated 30.04.2022, passed in Misc. Case No. 80 of 2018, Sri Rakesh Chand Gupta Vs. Smt. Renu Gupta and another, by the court of 4th Additional Civil Judge (Senior Division), Dehradun. By it, the succession certificate has been granted in favour of the respondent. It is informed to the Court that pursuant to the impugned judgment and order, succession certificate has been issued and amount has already been withdrawn. Learned counsel for the appellants submits that the succession certificate cannot be granted in respect of the policy document. But, he submits that post impugned judgment and order, succession certificate has already been issued and the amount has been withdrawn, therefore, he seeks permission to withdraw the appeal with the liberty to seek appropriate remedy before an appropriate forum.
