This application has been moved by the original writ petitioners, seeking release of the amount deposited by the respondent-H.P. State Forest Development Corporation Limited in their favour.
It be noticed here that an amount of Rs.46,42,787/- had been deposited by the respondent-Corporation in the Registry of this Court. In view of the said deposit, COPC No.453 of 2023 (Hari Ram and others Versus Dr. Pawnesh Kumar) was disposed of on 04.12.2025 as under:-
“Learned counsel for the respondent has placed on record letter dated 01.12.2025 addressed to learned Registrar of this Court and on that basis submits that amount due and admissible to the petitioners in terms of
judgment has been deposited in the Registry of this Court.
2. In view of above, these contempt proceedings are closed. Notice issued to the respondent is discharged. The release of amount will abide by the outcome of Special Leave to Appeal (C) No. 26610 of 2025 (H.P. State Forest Development Corporation Ltd. & Ors Vs. Bhag Chand) pending before Hon’ble Apex Court.
Pending miscellaneous application(s), if any, also stand disposed of.”
Special Leave to Appeal (C) No.26610 of 2025 (H.P. State Forest Development Corporation Ltd. & Ors. Vs. Bhag
Chand) has been dismissed on 09.01.2026. Accordingly, this application has been moved seeking release of the deposited amount in favour of the applicants/petitioners (09 in number).
Respondent has filed reply to the application. Paragraph 14 of the reply on merits tabulates the amount admissible to each of the petitioners. Learned counsel for the respondent submits that the respondent has now no objection for release of the deposited amount in terms of the aforesaid tabulation.
Learned counsel for the applicants/original writ petitioners has consented to the same and also admits the tabulation to be correct depiction of respondent’s liability towards the writ petitioners.
In view of above, the present application to stand
disposed of. The amount deposited by the respondent in the Registry of this Court be released to the applicants/ original writ petitioners in terms of the details given in para 14 of the reply on merits alongwith upto date interest, if any. The amount be credited in their bank accounts, details whereof shall be supplied by learned counsel for the applicants/petitioners to the Registry within a week.
