CMP No.15731/26 in FAO No.167 of 2023 The present application has been filed on behalf of the applicants/respondents No.1 and 2, seeking release of the awarded amount in the case at hand. No reply is intended to be filed on behalf of the non-applicant. Non-applicants have no objection, if in case the present application is allowed and the amount lying deposited in the Registry of this Court is ordered to be released in favour of the applicants. By way of the impugned award dated 21.10.2022, passed by the learned MACT-I, Kangra, District Kangra, HP, a compensation of Rs.41,61,776/- along with interest @ 7.5% per annum from the date of filing of petition, till realization of the entire amount had been jointly and severally passed against the appellant and respondent No.3. The aforesaid amount so awarded was to be shared inter se the applicants in the ratio of 60:40. Applicant-Shivani Katoch was held entitled to 60% of the awarded amount, whereas applicant-Tanishi was held entitled to 40% of the awarded amount. Other than the aforesaid, for the reasons mentioned in the application, application is allowed and 25% of the total amount, lying deposited in the Registry of this Court i.e. 25% of each applicants share, is ordered to be released in favour of the applicants along with the upto date interest accrued thereupon. The same be remitted in the bank account of the applicants, details whereof have been given in para 5 of the application, subject to proper verification of their identities.
